The Trump Administration Seeks Top Court Approval for National Guard Personnel in Illinois

Judicial Challenge Over Guard Activation

In an urgent petition, the justice department urged the court to reverse a lower court ruling that had halted the stationing of a few hundred state guard personnel to the greater Chicago.

The district judge had voiced concerns about the administration's reasoning for deploying forces, challenging its explanation in given the situation on the ground.

A federal appeals court affirmed the previous order on Thursday, maintaining the stationing on standby while the judicial dispute continues.

Administration's Arguments

The solicitor general, acting for the government, wrote in the latest petition that federal agents have often been “threatened and assaulted” in the city of Chicago and the neighboring town of Broadview community.

This area is home to an federal immigration detention center.

The former president has previously dispatched national guard personnel to the Windy City and Portland, Oregon, subsequent to earlier sendings to Los Angeles, California, the city of Memphis, and Washington DC.

The administration has argued that armed forces involvement is needed to control demonstrations and support deportation efforts.

Opposition leaders have vehemently criticized the decision, claiming that the president’s claims are overstated and partisan in nature.

At the core of the conflict is the administration's application of a federal statute permitting the executive branch to take control of the national guard only in instances of uprising or when “incapable with the standard military to carry out the regulations of the US”.

The White House argues that the personnel are required to safeguard federal property and agents from protesters.

In recent weeks, the White House nationalized three hundred personnel of the state guard of Illinois and commanded additional Texas national guard troops into the Illinois.

As state authorities criticized the move, the White House escalated his rhetoric, calling on the arrest of the city's leader and the state's chief executive, both Democrats, charging them of not managing to safeguard ICE personnel.

Illinois and municipal government filed a combined lawsuit the government to block the deployment.
